M&CO Legal was pleased to participate in the opening session of the Asset Recovery Series, titled “View from Our Host Nation”, which examined recent developments in fraud and asset recovery cases in the United Arab Emirates. The session brought together leading practitioners to discuss emerging trends, key challenges, and practical strategies for navigating the UAE’s evolving legal landscape.
During the session, Dr. Mahmood Hussain presented the Conflicts of Jurisdiction Tribunal, established under Dubai Decree No. 29 of 2024. He highlighted Decision No. 2 of 2025, which restricts the DIFC Courts’ jurisdictional reach and clarifies the limits of conduit jurisdiction — a significant development for practitioners operating across onshore and offshore judicial frameworks.
The panel also featured insights from Walid Azzam, Partner at Hadef & Partners (UAE), and Fatima Balfaqeeh, Independent Arbitrator at Matouk Bassiouny & Balfaqeeh (UAE), with moderation by Ros Prince, Partner at Stephenson Harwood LLP, and Dr. Qaisar Hamed Metawea, Managing Partner at Dr. Qaisar H.
